Booking Terms

TERMS AND CONDITIONSConfirmation Of Booking 1. These terms are applicable to all Contracts of any kind made by bookings (The Client) and Capsulezone Management Ltd. Trading as www.ShortLettingsLondon.com apply to all reservations, bookings and agreements for accommodation. Confirmations of a booking by the Client deemed acceptance of these terms on behalf of the Client and its guests. Cancellation Policy 2. If a Client or their guest wishes to depart earlier than the reserved departure date they must follow the cancellation terms of their booking. 3. Any cancelled or amended bookings that were processed by credit card will not be refunded the credit card surcharge. 4. If a cancelled or amended booking was booked under a promotional rate or code no refunds will be given. 5. The Client must provide at least 7 days written notice to apply for and extension to the reserved move-out date. Short Lettings London will endeavour to grant any requests for such extension, however this will be strictly subject to availability and can not be guaranteed. An alternative apartment may be offered if the apartment that was initially booked is unavailable for all or any part of the extension period. 6. These terms and conditions apply to an extension of the booking as they do to the original booking. 7. Whilst all reasonable efforts have been taken by Short Lettings London to ensure that bookings made are able to proceed, Short Lettings London reserves the right to relocate any booking to another apartment similar size and standard. The Client has right to cancel such booking in this circumstances but the client acknowledges that Short Lettings London will not accept any liability for any lost or damage suffered by or caused to the Client or its guests in the consequence of (i) the relocation of the Client or its guests or (ii) the Clients subsequent cancellation in accordance with the cause.Arrival and Departure 8. Check in time is between 14.00-21.00 pm. 9. Upon arrival to www.ShortLettingsLondon.com will request a copy of photo identification and the credit card used to make booking. This is carried out as a normal security check, in the interest of parties to protect Short Lettings London , the Client and its guest against fraud. 10. Upon arrival to www.ShortLettingsLondon.com may require a pre- authorisation of a credit card at check in. ( Cash is also acceptable ). No money is transferred at that time and the pre-authorisation used to cover incidental items including ( but not limited to ) breaches of these terms and conditions; breakages; damage to the apartment, excessive cleaning above the normal level cleaning due to the apartment being left in an unacceptable state of cleanliness. ( Please note that the pre-authorisation may affect available funds balance or spending limit on the credit debit card used at the time of check-in for a period of 5 days ( please note that this is an indicative timescale only.) Once a pre-authorisation has been made, Short Lettings London cannot release remove lower authorised amount until Short Lettings London process the final account after departure. 11. www.ShortLettingsLondon.com reserves right to refuse a quest entry and accommodation, if ,on arrival, London Short Lettings‘s management considers that the guest is under the influence of drink or drugs, is unsuitable dressed or is behaving in a threating, abusive or otherwise unacceptable manner. 12. On departure, guest must vacate their apartment and check-out by no later than 11 am. Failure to do so will entitle Short Lettings London to charge £60 plus VAT for check-outs after 11 am before 2 pm. And a full night’s stay for check-outs 2pm or agreed date of departure. 13. Short Lettings London reserves the right to remove a guest’s belongings from the apartment if the guest failed to check out by 11 am on the agreed date of departure and Short Lettings London accepts no liability for any loss and whatsoever of or damage to these items. Guest Responsibilities 14. The guest acknowledges receipt of and agrees to abide by the apartment rules and procedures in force from time to time including but not limited to health and safety and security procedures and statutory requirements. 15. The client agrees to ensure that any guest abides by the apartment rules and procedures referred to in clause 22. 16. Guests are responsible for their own belongings whilst their stay at the apartment. 17. No animals of any kind permitted in the apartment except guide dogs. 18. All Short Lettings London are non-smoking apartments and a charge of one night’s stay will be levied for any breach of this clause. 19. Children under 14 must be supervised by a adult guest at all times. 20. The Client accepts full responsibility for any damage occasioned to the apartment or its contents beyond normal wear and tear. Guest must forthwith notify Short Lettings London of all damage, loss, or broken items or matters requiring maintenance. 21. The maximum room occupancy for 1 bedroom flat follows; 1 double bed and 2 sofas, 2 bedroom flats 2 double rooms 1 is including double bed and the other room includes 2 single beds and 2 sofas. Notwithstanding 1 bedroom flat is maximum for 4 people and 2 bedroom flats are for upto 5 people.the studio flats have one double bed and 2 sofa beds which is 4 people ( may vary) 22. Short Lettings London has a strict no-party policy. The maximum number of people at the flat should not be exceed and noise levels must not cause a disturbance to Short Lettings London ‘s staff or other guests. In the event that Security will be contacted and a minimum charge of £500.00 of would be chargeable. 23. Short Lettings London reserves the right to require a guest to leave if she/he is causing nuisance or annoyance to other guests or Short Lettings London ‘s staff or behaving in an unacceptable manner where this occurs no refund will be given. Broadband24. Short Lettings London will not be held responsible for any loss or damage to Client’s or guest’s computer hardware or software or any information stored in a computer whilst connected to the broadband connection at the apartment. 25. No Client or guest must use the broadband connection at the apartment for any illegal or immoral purposes.Non Creation Of Tenancy 26. Neither the Client nor guest have exclusive access to the apartment Short Lettings London , and authorised by Short Lettings London have right to access to apartment at all responsible times ( but all times in case of emergency ) without notice is being given to the Client or guest. 27. These terms and conditions constitute an excluded agreement under section 3A(7)(a) of the Protection from Eviction Act 1977 (as amended). They cannot be construed as an assurance tenancy under the Housing Act 1988 as amended. Limitation of Liability 28. Short Lettings London accepts no responsibility for loss or damage of guest’s property. Short Lettings London encourages all guests to carry travel insurance in the unlikely event such as incidents. Short Lettings London suggests the policy include ,but not limited to the following coverage.- loss of payment through cancellation, loss or damage to personal baggage, loss of money and medical expenses. 29. Short Lettings London shall not be liable to the Client, whether in contract, tort (including negligence) breach of statutory duty or otherwise, for any loss of profit or any indirect or consequential arising under or in connection with these terms and conditions other than death or personal injury caused by its negligence, or negligence of its employees. Miscellaneous 30. Short Lettings London shall not be liable to the Client as a result of any delay or failure to perform its obligations under these terms and conditions as a result of a Force Majeure Event. For the purpose of these terms and conditions, a Force Majeure Event means an event beyond the reasonable control of Short Lettings London including but not limited to strikes, lock-outs or other industrial dispute (whether involving the workforce of Short Lettings London or any other party) failure of a utility service or transport network, act of G od, war, riot, civil commotion, malicious damage, compliance with a law or governmental order rule regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm, or default of suppliers or subcontractors. 31. If a court or any other competent authority finds that provision of this terms and conditions ( or part of any provision) is invalid , illegal, or unenforceable, that provision or part provision shall, to the extend required, be deemed deleted, and the validity and enforceability of the other provisions of these terms and conditions shall not be affected. 32. If any invalid, unenforceable or illegal provisions of these terms and conditions would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make legal, valid and enforceable. 33. Variation Excepts as set out in these terms and conditions any variation, including the introduction of any additional terms and conditions shall only be binding when agreed in writing and signed by Short Lettings London 34. These terms and conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation ( including non-contractual disputes or claims) shall be governed by, and construed in accordance with, English Law, and the parties irrevocability to the exclusive jurisdiction of the courts of England and Wales.
